By accessing or using Bit Refinery's cloud hosting services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.

These Terms constitute a legally binding agreement between you and Bit Refinery ("Company", "we", "us", or "our").

Bit Refinery provides cloud hosting, infrastructure, and related services. Our Services include but are not limited to:

• Virtual private servers and dedicated hosting
• Cloud storage and backup solutions
• Database hosting and management
• ClickHouse database services
• Technical support and consulting

To use our Services, you must create an account and provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Immediately notifying us of any unauthorized use
• Ensuring your account information remains accurate and up-to-date

You agree not to use our Services for any unlawful purpose or in any way that could harm our Services or other users. Prohibited activities include but are not limited to:

• Violating any applicable laws or regulations
• Distributing malware, viruses, or other harmful code
• Engaging in spamming or unsolicited communications
• Attempting to gain unauthorized access to our systems
• Using excessive system resources that impact other users
• Hosting illegal content or engaging in illegal activities
• Infringing on intellectual property rights

Payment for Services is due according to the billing cycle you select. You agree to:

• Pay all charges on time according to your selected billing cycle
• Provide accurate billing information and update it as needed
• Pay any applicable taxes
• Accept responsibility for all charges incurred under your account

We reserve the right to suspend or terminate Services for non-payment. All fees are non-refundable unless otherwise specified.

We strive to provide reliable Services but cannot guarantee 100% uptime. Our standard Service Level Agreement includes:

• 99.9% uptime commitment for most services
• Planned maintenance windows with advance notice
• Service credits for qualifying outages

Specific SLA terms may vary by service tier and are detailed in your service agreement.

You retain ownership of your data and content. By using our Services, you grant us the right to:

• Store, process, and transmit your data as necessary to provide Services
• Access your data for technical support when authorized by you
• Make backup copies for data protection purposes

You are responsible for maintaining backups of your data and ensuring you have the right to use all content you upload to our Services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIT REFINERY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE.

Our total liability for any claims arising from these Terms or our Services shall not exceed the amount you paid us in the twelve months preceding the claim.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Either party may terminate this agreement at any time. We may suspend or terminate your Services immediately for:

• Violation of these Terms
• Non-payment of fees
• Suspected illegal activity
• Risk to our systems or other users

Upon termination, you must immediately cease using our Services and remove any content you have stored with us.

Our Services, including all software, technologies, and documentation, are protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer our Services without our written permission.

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles. Any disputes shall be resolved in the courts of [Your Jurisdiction].
